How long do I have to be separated before I can get a divorce in Australia?

To apply for a divorce in Australia, you must prove that your marriage has irretrievably broken down by being separated for a continuous period of at least 12 months.

Do we need to go to Family Court to agree on child custody arrangements?

Going to court is usually a last resort. Parents are encouraged to reach an agreement through family dispute resolution and formalise it using a Parenting Plan or Consent Orders drafted by a family lawyer.

How are property and assets divided after a separation?
